Terms of Use and License Agreement

These terms are an agreement between you and NesDesign LLC, a US company (“we”, “us”), for the Vibe Console Mac app, Vibe Remote for iPhone, and their account and relay services (together, the “Services”). By using the Services, you accept these terms. If you do not accept them, do not use the Services.

1. Mac trial and free local connection

Vibe Console includes a 14-day Mac trial starting on first use. It does not automatically become a paid subscription. When the trial ends, continued paid Mac features require an active subscription or an earlier permanent license. A paired iPhone can connect over the same local network for free without using our servers or buying a subscription.

2. Subscriptions and billing

Monthly and yearly subscriptions unlock Mac access and Connect from anywhere for eligible paired devices. The price, currency, taxes and billing period are shown before purchase; these terms do not set a fixed price. Subscriptions renew for the chosen period until canceled. If you cancel, access continues through the paid period unless a refund or another merchant action ends it sooner. A subscription does not include the third-party AI tools or their usage fees.

iPhone purchases are made through Apple, the merchant for those purchases, under Apple's applicable billing terms. New Mac web purchases require email verification and are handled by Paddle, the merchant of record, through a RevenueCat purchase link. RevenueCat processes subscription status; it is not a separate merchant. We do not receive your card details. Manage or cancel the subscription through Apple or Paddle, whichever billed you. Refunds are handled by that merchant and any applicable law; see our refund policy.

One customer may enroll up to three Macs and three iPhones. Adding a device beyond a limit requires you to choose and revoke an existing device; we do not remove one automatically. An iPhone may subscribe without first owning a Mac, but using Remote requires a Mac that is on, paired and reachable. A subscription does not pair devices or turn on Connect from anywhere on your Mac for you.

3. Remote connection

Connect from anywhere uses an end-to-end encrypted relay we operate. The relay forwards the traffic but cannot read terminal content, and it stores no session content or connection history. It may be unavailable because your Mac is off or asleep, a network is down, or the service is interrupted. Same-network connections remain free and do not pass through our servers. 4. Earlier permanent licenses

Customers who bought the earlier one-time Mac license through Polar keep their Mac access for life under the terms of that purchase. Their license does not expire merely because the new subscription plans exist. Connect from anywhere is a separate subscription feature. Earlier purchases and refunds remain subject to the terms offered when those purchases were made.

5. License and account

We grant you a personal, non-exclusive, non-transferable license to use the apps while you have trial, subscription or earlier permanent access. The apps are licensed, not sold; we and our licensors keep all rights not expressly granted here. Do not share, sell, rent or sublicense the apps or your access credentials. Apple's applicable App Store terms also govern Vibe Remote obtained through the App Store.

You can delete your customer account from either app. Deletion revokes its devices and pairings but does not cancel Apple or Paddle billing, remove files on your Mac, or cancel an earlier permanent Mac license. The app shows a billing warning and a management route before deletion.

6. Updates and third-party tools

We may update the apps and Services while they are offered. An active subscription covers access during its paid period; an earlier permanent license keeps the rights promised at its purchase. Agent CLIs, skills and services you install or sign in to yourself, such as Claude Code, Codex and Gemini CLI, are provided under their own terms. You are responsible for those accounts and their usage. We do not provide access to AI models.

To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. The apps run commands and agents with your access to your files; you are responsible for what you run and for keeping backups of your work.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or business arising from use of or inability to use the Services. Our total liability for a claim relating to the Services is limited to the amount you paid for them. Some jurisdictions do not allow these limitations; in that case they apply only as far as permitted.

10. Termination

Subscription access ends when its paid entitlement ends. We may end access if you materially breach these terms, subject to applicable law. Ending an account does not cancel billing; manage it with the merchant. Restrictions, ownership, disclaimer, liability and general terms survive termination to the extent applicable.

11. General

These terms are governed by the laws applicable at our US place of business, without regard to conflict-of-law rules, and do not limit mandatory consumer rights where you live. If a provision is unenforceable, the rest remains in effect. We may update these terms; changes do not remove rights already granted under an earlier permanent purchase.
