Terms of Sale and License Agreement

These terms are an agreement between you and nesdesignco (“we”, “us”) for the Vibe Console macOS app (the “Software”). By downloading, installing or using the Software, or by buying a license, you accept these terms. If you do not accept them, do not use the Software.
1. Free trial
The Software includes a 14-day free trial with all features, starting the first time it runs on a Mac. When the trial ends, the main console window locks until a valid license key is entered. The notch keeps working without a license. Trying to reset or extend the trial is not permitted.
2. Purchase
A license costs a one-time $29 (USD), plus any taxes shown at checkout. Orders are processed by Polar (polar.sh), which acts as merchant of record and handles payment, invoicing and taxes. Your license key is sent to the email address you use at checkout. Refunds follow our refund policy.
3. License grant
- We grant you a personal, non-exclusive, non-transferable license to use the Software. A license is for one person.
- You may activate your license on up to 3 Macs that you use. You can free an activation in Settings → License to move the license to another Mac.
- The Software confirms your license with our license server (operated by Polar) when you activate it and periodically afterwards, at least once every 30 days, so it needs an occasional internet connection.
4. Updates
Your license includes every version of the Software released during the first year after your purchase. You may keep using any of those versions, including the last one released within that year, for as long as you like; your license does not expire. Versions released after that year are not included.
5. Restrictions
You may not, and may not allow others to:
- share, sell, rent, sublicense or otherwise redistribute the Software or your license key;
- reverse engineer, decompile or disassemble the Software, except to the extent applicable law expressly permits it despite this restriction;
- remove, bypass or tamper with the trial, license checks, or any notices in the Software;
- use the Software to break the law or the terms of third-party services you connect to it.
6. Third-party tools and services
The Software starts agent CLIs, skills and other tools that you install and sign in to yourself (for example Claude Code, Codex or Gemini CLI). They are provided by third parties under their own terms, and you are responsible for your accounts, subscriptions and usage with them. We do not provide access to AI models.
7. Ownership
The Software is licensed, not sold. We and our licensors keep all rights, title and interest in it, apart from the rights granted to you in these terms.
8. Disclaimer
To the maximum extent permitted by law, the Software is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. The Software runs commands and agents in your terminals with your user's access to your files; you are responsible for what you run and for keeping backups of your work.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or business, arising from your use of or inability to use the Software. Our total liability for any claim relating to the Software is limited to the amount you paid for your license. Some jurisdictions do not allow these limitations, in which case they apply only as far as permitted.
10. Termination
Your license ends automatically if you breach these terms. When it ends, you must stop using the Software and delete your copies. Sections 5 to 11 survive termination.
11. General
These terms are governed by the laws that apply at our place of business, without regard to conflict of law rules, and do not limit any rights you have under mandatory consumer protection laws of your country. If any provision is found unenforceable, the rest remains in effect. We may update these terms; the version in force when you bought your license applies to that purchase.
